One-Year Limited Warranty
Cloudtail India Private Limited hereby warrants to the original retail purchaser of Amazon Basics branded chairs that the Products are free from defects in material, design and workmanship if used in accordance with the operating instructions provided to You along with the Product and pursuant to the following terms and conditions
- 1. This warranty shall be valid for a period of 1 (One) year from the date of purchase of the Product from Cloudtail.
- To be eligible for this warranty coverage, You have to present a valid invoice in respect of the Product, as and when requested by Cloudtail or its representative(s).
- If the Product is found to be defective during the validity of the warranty period, then subject to the other requirements of this warranty being met, We may, at Our sole discretion, take either of the following actions in respect of the defective Product:
(a) replace the Product that is the same as or similar to the Product You purchased; or (b)refund to You the purchase price of the Product. However, any such refund shall not be subject to any interest charges. There is no assurance, representation or warranty that any replacement Product will be identical to the Product You purchased. - This limited warranty applies only to Products purchased within the territory of India and shall be governed by the laws of India.
- Replacement of the Product will only be delivered to addresses where the Product was originally shipped, and such address shall be within the Territory. At Our discretion and upon Your request, We may agree to ship the replacement Product at an address other than the original Product delivery address.
- Refunds, if any, shall be credited subject to the following: (a) in case of pre-paid orders, refund shall be credited to the same account through which the original order for the Product(s) and its payment thereof, was made.
(b)in case of cash-on-delivery orders, refund shall be credited only to Your own account located
within the Territory. - This limited warranty does not extend to Products which have been subjected to and/ or suffer from:
(a) damage on account of accident, misuse, neglect, fire or other external causes; or
(b) unauthorized use, alterations or repair, or which have been rented/leased; or
(c) defects or parts requiring replacement due to ordinary wear and tear, corrosion, rust or stains, scratches, dents on casing or paintwork of the Product; or (d)resale or transfer by You to any person; or (e) use that is not as per the Product operating instructions. - This limited warranty shall also extend to any Product replaced under this warranty, for the remainder of the original warranty period or for 90 (Ninety) days from the shipment of the replacement Product to You, whichever is later. All Products that You return to Us and for which We give You a refund or replacement will become Our property upon Our receipt of them, and You agree 2 that any unexpired period of this limited warranty on the replaced or refunded Product also transfers to Us.
- Cloudtail reserves the right to vary, modify or change the terms and conditions herein due to change(s) in availability of services, Products and/or spare parts or for the purposes of complying with applicable policies, rules, regulations and law, with or without notice.
- Cloudtail shall not, under any circumstance, whether as a result of breach of contract or warranty, tort, or otherwise, be liable for any incidental, special or consequential damages, including loss of profits or revenues or any other costs or damages. This warranty shall not in any manner extend to personal injury and/ or death caused by the user’s own negligence or omissions.
- Cloudtail’s total liability for damages relating to or arising out of Your purchase or use of Product regardless of the type or cause of such damage or the characterization of the claim asserted (whether in contract or tort) shall not exceed the original price paid for the Product. To the maximum extent permitted by applicable laws, the remedies in this warranty are Your sole and exclusive remedies and Cloudtail’s total liability in respect of the Product, howsoever arising out of, relating to or in connection with this warranty, shall not under any circumstances exceed the Product’s purchase price as on the invoice and the period of warranty as provided herein.
- This warranty does not cover minor imperfections in the Product that broadly meet design specifications, or imperfections that do not materially alter the Product’s functionality.
- Purchasers are required to satisfy themselves regarding the suitability of the Product before making any purchase. Cloudtail does not make any representation or warranty as to the suitability of the Product for any particular use.
- For further instructions or assistance in respect of this warranty, contact Cloudtail’s customer service at the following1800-419-0416| cloudtail@blubirch.com Customer service will ask You questions to determine Your eligibility under this limited warranty. If You are eligible, a replacement order or refund will be issued, and You will be given instructions for returning the defective Product at Your own cost to Us.
